What Kindly is

Kindly is an end-of-life planning assistant. It provides general guidance and personalised checklists to help you manage estate and end-of-life matters.

Kindly is not a law firm and does not provide legal, financial, or tax advice. Nothing on this platform constitutes professional advice. Always consult a qualified lawyer, accountant, or financial adviser for your specific situation.

AI-generated content

Kindly uses third-party AI to generate responses. AI output may contain errors, omissions, or out-of-date information. Verify anything critical with a qualified professional before acting on it.

Intellectual property

Kindly's content. All software, design, copy, illustrations, and other materials made available through Kindly are owned by us or our licensors. You may not copy, modify, redistribute, or reverse-engineer any part of the service without our written permission.

Your content. You retain ownership of everything you submit to Kindly — your intake responses, plan data, and Ask Kindly chat messages. By submitting content, you grant Kindly a worldwide, non-exclusive licence to store, process, and display it solely as needed to provide the service to you. We do not claim ownership of your content and we do not use it to train AI models.

AI output. Output generated by Ask Kindly is provided to you to use, save, or share as you see fit. Kindly makes no claim of ownership over AI-generated output.

Warranty and liability

Kindly is provided “as is” and “as available”, without warranties of any kind, express or implied, including but not limited to fitness for a particular purpose, accuracy, completeness, or non-infringement.

To the maximum extent permitted by law, Kindly's total liability arising out of or related to your use of the service shall not exceed the amount you have paid to use Kindly in the twelve months preceding the claim, or ZAR 0 if you have made no payment.

Nothing in these terms excludes or limits liability that cannot lawfully be excluded under the South African Consumer Protection Act or other applicable consumer-protection law.

Your account

You are responsible for keeping your account credentials secure. You must not use Kindly for any unlawful purpose.

What Kindly is not responsible for

  • Decisions you make based on Kindly's guidance
  • Accuracy or completeness of AI-generated responses
  • Changes in law or jurisdiction-specific requirements after the date shown on any content
  • Loss of data caused by circumstances outside our control

Account termination

We may suspend or terminate your account if you misuse the service. You may delete your account at any time at https://kindly.potfiction.com/account/delete.

Changes to these terms

We will notify you of material changes by updating the “Last updated” date above. Continued use of Kindly after changes constitutes acceptance.

Governing law

These terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the jurisdiction of the South African courts.
